Healthcare scandals. many suspects. All acquitted

Editor's note: Riportiamo un articolo che ripercorre vari scandali avvenuti in Emilia Romagna. Fra questi viene ripreso il cosiddetto “Caso Pasimafi” che ha visto fra gli imputati il Prof. Fanelli, Direttore della Terapia del Dolore all’ospedale Maggiore di Parma. Nell’articolo si dice testualmente: “A fine 2018 il PM Amara, coordinato dalla collega Paola Dal Monte, deposita 75 requests for indictment: 65 people, including doctors, pharmaceutical company executives and scientific informants, e 10 società”. 

L’articolo vuol dimostrare che le inchieste su presunti scandali sono state “montate” e si sono concluse con assoluzioni.

È bene precisare, indipendentemente dalle assoluzioni, che nessun informatore scientifico del farmaco era implicato in questa vicenda neanche come indagato né è stato oggetto di richiesta di rinvio a giudizio. Anzi è bene sapere che l’illustre Prof. Fanelli non riceveva ISF, forse non degni di andare al suo cospetto. Riceveva invece dirigenti aziendali, direttori marketing e qualche area manager. Nessuno di questi è ISF. Inoltre è bene sapere anche che gli ISF dipendono da un servizio scientifico. La stampa, ignorando chi sono e cosa fanno gli ISF, aveva definito come tali altre figure professionali che nulla hanno a che fare con gli ISF.

Pasimafi, Volume VII: "Thus Parma has become the Levante of the Nas"

Come la fama di successo e risultati può far deviare dalla vera mission…

Once upon a time there was a king, who said to his lady, tell me a fairy tale. And the lady began”.

But more than a fairy tale, what our lady tells is an uncomfortable and ugly truth. It's a lust for power, a desire to be on the front page, to earn praise and promotions.

What's the price ? Bankrupt companies and broken families? It doesn't matter if the aim is to have a front page and the canonical 15 minutes of fame. Co-protagonist role, of course, who writes the front pages and gives the celebrity: the press.

The enslaved but also the free one, blinded by the clamor and by the many certainties of the roundups, competed in the loudest and most violent title because the guardians of order who had to do justice said that "Mister X" was a heinous criminal. Even if it took years to realize that this was not the case.

Our fairy tale begins with Professor Modena. Too feminine, too beautiful, too excellent to be accepted by provincial Emilian mediocrity. To be tolerated.

We told you about her. Impossible to forget "Dirty Shirts". On November 9, 2012, at dawn, by order of the GIP of the Court of Modena, 150 carabinieri of the NAS of Parma, in ten Regions, arrested 9 cardiologists, carrying out 33 searches and applying the measure forbidding contracting with the Public Administration for 12 companies, half of which were foreign, which produced sanitary equipment, applying the ban on the exercise of the activity against 7 people. 70 suspects.

In September 2013, the magistrates asked for the indictment of 34 suspects: 14 doctors, 20 directors, 15 companies in the biomedical sector. In April 2021, after 8 years, with the Modena prosecutor's waiver of the appeal to the Cassation, the acquittal for all suspects is confirmed. It is the first of a trilogy of flops.

Then Dialbolik. Rich Parma. The village where everyone knows everything about everything. Mediocrity as a law of life, a choice of survival. The streets of salami, culatello and parmigiano are the only excellences granted. This time the Fornovo dialysis center ends up under fire from the Parma NAS.

On April 1, 2016, after having identified a high-sounding name for the investigation, the carabinieri of the Parma NAS they arrest, on behalf of prosecutor Amara, the administrator and the head nurse of the dialysis center.  Interdictive measures for the health director of the center, a seizure aimed at confiscation, 7 suspects. They were all indicted and all acquitted in January 2020 and definitively after the prosecutor's waiver of the appeal of the trial Dr. Francesca Arienti.

And finally Pasimafi. Sbadabam. A center of pain at the top, led by a non-Emilian and non-politicized luminary. Never be! Everything will be destroyed with the patients left to fend for themselves.

A brief summary for those who missed some episodes of this investigation, called Pasimafi from the name of the vessel of the main defendant, Professor Guido Fanelli.

The investigative tandem is always the same: Giuseppe Amara and the carabinieri of the Parma NAS.

On 8 May 2017, again at dawn, 200 carabinieri began one of the largest roundups of doctors and entrepreneurs operating in the marketing and promotion of drugs and medical devices. The investigators hypothesize corruption for over half a million euros.

There are 19 arrested, 75 suspects on the loose.

At the end of 2018 Amara, coordinated by her colleague Paola Dal Monte, deposited 75 requests for indictment: 65 people, including doctors, pharmaceutical company executives and scientific informants, and 10 companies.

The 5 November 2019, the GUP of the Court of Parma transfers the 70% of the charges for territorial jurisdiction to the Prosecutor of Lecco, a further 10% And removed to the Public Prosecutor's Office of La Spezia.

On 10 March 2020, the court of Lecco filed the position of all the suspects "for unfounded crime reports". For Fanelli noted "the absence of acts of corruption". On 24 February 2021, the Court of La Spezia also dismissed the charges for "unfounded news of a crime". For the 20% of the allegations remaining in Parma, the trial is scheduled to begin on June 18th.

The protagonist of this ugly fairy tale? Always the same.

Who? The carabinieri of the Parma NAS. Born to protect food excellence, they have become hungry for health scandals.

With them, the prosecutor "who out of cowardice made the great refusal", Dante would say. In this case you agree, helpless. He doesn't investigate, he takes everything for good. It is an accusation without being an investigator. In return, promotions and praise poured in.

Let's get to know these public health guardians better. Making a small comparison with other guardians, that of the public order of the Carabinieri station of Piacenza Levante, sadly known for the way they carried out investigations against pushers and drug dealers.

At the basis of their conduct there was  the unscrupulous desire to make a career, theirs and that of their superiors who fueled their initiatives with a single purpose: to carry out as many operations and arrests as possible. The carabinieri of the Levante barracks were also rewarded, during the ceremony for the 204th anniversary of the Arma Foundation organized in June 2018 in Bologna, "for having distinguished themselves for their remarkable operational and institutional commitment and for the results achieved above all in the activity of contrasting the phenomenon of drug dealing" .

Under the aegis of the State, wrote the magistrate, an illicit activity of infiltration and information on drug dealing activities in the city had been fueled, through informants enlisted among the carabinieri themselves, paid for the service with the proceeds of the seizures carried out thanks to the their tips: the use of illicit methods such as drug dealing and violence for a higher purpose such as the fight against crime, to be defeated by violating the law.

But what was the objective of the Parma NAS carabinieri? The same. Get the highest number of arrests of a different target: not drug dealers but white-collar workers: university professors, researchers, chief physicians, doctors, nurses, administrators of pharmaceutical and medical device companies. All this, as for the Levante, in order to increase operating statistics and gratifying themselves, their superiors, the prosecutors who obtained the coveted celebrity.

In the Levant the gang leader was the pinned Montella who had dragged the other colleagues into committing criminal acts and had isolated those who did not conform to the system.

And among the carabinieri of the Parma NAS who was the leader of this independent group, isolated from the rest of the colleagues who continue to operate with diligence and accuracy,  who pursued the goal of incarcerating the largest number of white-collar workers, reaching mind-boggling numbers in just three investigations, 30 arrested and over 150 suspects?

His name is known, it is the chief marshal Giandomenico Nupieri, assisted by colleagues Michele Nobile and Bruno Cosentino.

Let's say right away, to avoid misunderstandings, that Nupieri is not under investigation. We are happy for him. Here we are only interested in highlighting the elements in common with Montella.

Like the Piacenza officer, Nupieri is unable to hold back the desire to publicly display his status on social media: Rolex, luxury cars, fine wines, haute couture clothes, unobtainable cigars, starred dishes and the cult of one's physique and of one's intellectual and moral superiority, through a self-celebratory ostentation of one's beliefs, such as for example the Iron Cross of one's ring used during Nazi Germany or the tattoo bearing the motto "Memento Audere Semper" (Remember to always dare), in vogue in far-right circles. Is it normal for a policeman to publish such photos? Isn't there a code of conduct for apartments at the Arma?

Nupieri, like Montella, is not alone: the responsibilities are to be shared with his superiors who have allowed him to conduct investigations with hundreds of suspects and dozens of arrested, increasing the statistics of the Nucleus.

The first is Captain Angelo Balletta, who had himself portrayed with him for the weekly Gente a few days after the arrest of Professor Modena. He will obtain the rank of major and will be promoted to the provincial command of Piacenza, becoming the closest collaborator of the colonel commander.

Then the captain Gianfranco Di Sario, the successor, particularly inclined to be filmed by TV and to give interviews, took advantage of the media-judicial deriving from Pasimafi to also obtain a celebrity outside the national borders. Di Sario is one of the very few carabinieri, if not the only one, to have ended up on the Associated Press, the first international news agency.

Sounding results. show off. Because the front pages, as mentioned, everyone likes.

And we come to the pm.

The first is certainly the former prosecutor of Modena Vito Zincani, who with the Dirty Shirts affair hoped to round off his long career as a magistrate and to which Professor Modena in her book "The Case of Cardiology ... The Truth" will attribute the epithet of "principal investigator", a term used in the investigation to define the responsible coordinator of a clinical trial.

The "experimentation" was actually carried out by the Public Prosecutor's Office, as confirmed by whoever had replaced Zincani, Dr. Lucia Musti, in an interview after the final acquittal of Professor Modena in Cassation.

The script was repeated with Dialbolik and with Pasimafi. It is difficult not to mention the prosecutor Salvatore Rustico, supported by the carabinieri of the NAS and by the prosecutor Amara, engaged in a spectacular press conference in the reception hall of the Palazzo Ducale.

The hearing of what little of the Pasimafi investigation remained crutch in Parma is scheduled for 18 June 2021.

It will be interesting to see, as has already happened in the past, Nupieri sit on the prosecutor's bench, no longer only alongside Amara, now transferred to Modena even if aggregated to the Parma prosecutor's office for this hearing, but with that of the intransigent Paola Dal Monte, which he demonstrated, in the past, of not withyieldere all'Arma any extenuating to behaviorthe deviant that they can be dystonic with respect to an idea of equilibrium impartiality and firmness that justice must have with everyone includingto the Judicial Police.

As in all fairy tales, however, one hopes for a happy ending. May the good ones win. May those who have lost their assets, companies and careers find peace by having at least justice. Sometimes life. May those patients who believed in a doctor, and with him have lost hope and therapies, have justice.

Real victims. First victims of the hunger for power of those who should feed on justice.

For them, this battle is only just beginning.
