Dear colleagues and friends, the news of the government-approved bill that bypasses Article 18 of the workers' statute is recent. Many may have just heard the news, but many have probably not even fully understood its significance.
Here are some important steps:
· The obligation to attempt conciliation in individual labor disputes is no longer valid. Currently this attempt is a condition for proceeding with the judicial question (article 410 of the Cpc). Legislation immediately in force.
· The contractual parties can establish arbitration clauses to delegate the resolution of disputes to an arbitration board. This must be foreseen by collective labor agreements. Legislation immediately in force.
· The appeal against dismissal is ineffective if within the following 180 days the appeal is not filed in court or the attempt at conciliation or arbitration is not communicated to the other party. Legislation immediately in force.
· The binding value of the assessment carried out during the certification of employment contracts is strengthened.
Other important modifications concern:
· Sickness certificates (article 25).
Certification of the employment relationship and general clauses (article 30) Monocratic conciliation (article 38)
· Working hours (article 7).
· Permits for assistance to the handicapped (article 24).
Without intending to carry out an improper analysis and postponing the reading of the ABC of the online labor reform in the Sole 24 ore to the most interested, it seems clear to me that the worker actually sees many safeguards gained over time circumvented and eliminated. It's time to wake up, the little theater between the Triple Alliance, the Government and Confindustria has long been active to lull the workers' consciences. Let's wake up, otherwise these first serious steps are the antechamber of the all-round exploitation of the worker.
It's not just a problem of one sector or another, it's everyone's problem. Let's make our voice or dissent heard otherwise we will witness a silent carnage that will affect us all.
