Jobs act. Fiafant: "Non-owner pharmacists heavily penalized"

The National Labor Contract is the exact opposite, from the point of view of labor policy, compared to the Jobs Act; in the first, in fact, it is the parties who decide the rules and balances at stake, allowing the trade unions. to attempt to extract from the counterparty the maximum possible protections of a solidarity nature for all workers, even those less guaranteed by the laws. The Jobs Act, on the contrary, cancels the role of the parties, precarious the whole world of work, further weakening even those who already live in the constant blackmail of losing their jobs. The Jobs Act is the maintenance of differences and not the fight against precariousness”. Thus the president of the Federation of Non-Titular Pharmacists (Fiafant), Anna Attolico, commented on the Jobs Act.

“In fact, the existing one has been maintained, if not worsened, as in the case of ancillary and absurd work on collaborations that are announced to be abolished from 2016 but still stipulable in the majority of cases; nothing is said about cococo and vat numbers. Precarious work in the pharmacy will therefore continue with the same characteristics as always, the contract with increasing protections will also allow for dismissal as a disciplinary measure in the event of minor shortcomings; in fact, the proportionality between the unlawful act of the worker and the disciplinary measure is no longer valid, consequently the possibility of the worker to request compensation in the event of unjustified dismissal will be affected. A one minute delay, an error on a ticket can be grounds for dismissal – continued Attolico -. The Government has completely forgotten about VAT numbers but makes demotions possible and facilitates layoffs. Non-registered pharmacists will be heavily penalized, increasingly subject to blackmail and with a contract that has not been revised since 2009 in the regulatory part and since November 2011 in the economic part. It is possible that, considering the tax rebates, there will be some regularization of precarious workers, without prejudice to their dismissal in a very short time as allowed by the new law. Furthermore, the possibility of activating internships for young pharmacists instead of apprenticeships remains unchanged”.

“Pharmacists employed by the pharmacy would have needed a law that would reinforce the role of the National Contract, the only solidarity protection in a world so fragmented as to make the Workers almost always weak and alone in relation to the pharmacy owner. The National Contract is an identity tool of representation that should be strengthened and defended, we are convinced, on the contrary, that Federfarma's radical positions of refusal to dialogue feel stronger after the Jobs Act. At the same time, the 2015 Competition Law was a huge disappointment for non-registered Pharmacists, it only strengthened the power of big capital, nothing has been done to definitively streamline bankruptcy procedures and bureaucracy on new openings. Even the 'extraordinary competition' whose effects are still 'anaesthetized' in the majority of Regions seems to have gone by the wayside. Non-owner pharmacists deserve much more, they offer an irreplaceable service to the community every day, of high professionalism and competence: 5 years of scientific degree (therefore far from simple) plus state exam, strenuous working hours and methods, Enpaf mandatory also for those who, being employees, already pay contributions to INPS - concluded President Fiafant -. This opportunity has also been lost, there is the risk of creating a category of demotivated professionals, without hope and with a deep anger that sees no solutions".
