According to the indictment X-Pharma was brought into disarray by hiring personnel from French or Belgian multinationals who wanted to avoid opening mobility procedures for redundant workers, in exchange for sums paid as advances on monthly salaries and on severance pay for each worker hired, money used to obtain liquidity and drive up the value of X-Pharma's stock in an attempt to sell a nice empty box. When the sale project had not gone through, again according to the indictment, the defendants would have permanently drained the company's coffers causing it to fail and leaving almost half a thousand people out of work.
Accusations denied by the witnesses of the defence, belonging to the boards of statutory auditors of companies connected to X-Pharma or to the German parent company, according to which the directors of X-Pharma would have envisaged a situation of growth of the company up to the collapsed in 2008 for reasons no one knew about.
