The approval of the law n. 234/2021 (budget law for 2022) has brought about some changes to retire in 2022 for workers enrolled in the compulsory public social security.
The main novelty is the "Quota 102" which allows those born within the date to leave December 31, 1958 who accrue 38 years of contributions by 31 December 2022, but the renewal of female option and ofsocial bee with a further expansion of the audiences entitled to the service. But let's go in order.
Treatment of old age and anticipated
There is no news. For the achievement of early retirement they are always needed 42 years and 10 months of contributions for men (2227 weeks) e 41 years and 10 months of contributions women (2175 weeks) regardless of chronological age. The service in question is subject to a deferment mechanism for the first installment equal to 3 months from the accrual of pension requirements (both for the private sector and for workers in the sector
On the other hand, they are needed for old-age retirement 67 years old together with at least 20 years of contributions.
To employees assigned to particularly difficult and risky tasks referred to in Decree of the Ministry of Labor dated 5 February 2018 with at least 30 years of contributions, non-holders of the social bee at the time of retirement can achieve the old age pension to 66 years and 7 months. For the old age pension there is no application of any slip window: the pension begins, as a rule, on the first day of the month following the accrual of the requisites.
Odds 102
The law n. 234/2021 introduces the right to go out with 64 years old And 38 years of contributions (so-called quota 102) if the requirements are met between January 1st and December 31st 2022. Stay there floating window of three months for private sector workers and six months for the public sector. For workers in the school sector who meet the requirements by 31.12.2022 they will reopen until February 28, 2022 the deadlines for submitting applications for termination of service with effect from retirement from September 1, 2022

Those who have met the requirements for the cd. «Quota 100» (62 years and 38 years of contributions) by December 31, 2021however, he can also apply for retirement in 2022.
Social bee
The law n. 234/2021 also renews the social bee for the weakest categories in 2022: a) unemployed with full unemployment benefit exhaustion; b) civilian invalids at least to 74%; c) caregivers; d) employed in particularly «difficult and risky» activities.
Regarding the sub profile to) the law n. 234/2021 suppresses the reference to term of three months, requested after the full conclusion of the unemployment benefit due to those entitled to it.
Regarding the sub profile d) the law n. 234/2021 recognizes the benefit from January 1, 2022 not only (as already foreseen) to the employees included in the aforementioned Decree of the Ministry of Labor dated 5 February 2018 but also to the other activities contained in theattachment no. 3 of the law n. 234/2021.
The social bee is always achieved with a minimum of 63 years of age together with at least 30 years of contributions, 36 years old in «difficult and risky» activities. From 1 January 2022, however, the aforementioned 36-year requirement is reduced to 32 years old only for construction workers, potters and plant operators for the molding of ceramic and terracotta items.
Women regime
The law n. 234/2021 renews the women's option for female workers who have reached the 58 years old (59 if autonomous) together with 35 years of contributions by 31.12.2021 provided that they opt for the pension settlement with the contribution system (so-called women's option). For workers in the school sector affected by the extension, they will reopen until February 28, 2022 the deadlines for submitting applications for termination of service with effect from retirement from September 1, 2022.
The other exceptions
There is no news for insiders strenuous tasks and nocturnal which maintain the reduced requirements referred to in Legislative Decree n. 67/2011: in 2022 the exit can be achieved with 61 years and 7 months old, 35 years of contributions and the simultaneous improvement of the quorum 97.6.
Even for the precocious there is no news: in 2022 the reduced contribution requirement is confirmed 41 years yirrespective of age if you have carried out at least 12 months of effective work before turning 19 and you are in one of the following protection profiles a) unemployed with full unemployment benefit exhaustion; b) disabled at least to 74%; c) caregivers; d) employed in particularly "difficult and risky" activities included in the aforementioned Decree of the Ministry of Labor dated 5 February 2018; e) assigned to strenuous and nocturnal duties pursuant to Legislative Decree no. 67/2011.
Journalists
The aforementioned requirements will also apply to journalists enrolled in the substitute management of theINPGI(i.e. holders of employee employment relationships) starting from July 1, 2022. However, without prejudice to any pension rights already accrued by June 30, 2022 under the INPGI regime (with protection of acquired rights).

Also in 2022 different personal data and contribution requirements will remain in force with respect to the generality of the policyholders for those belonging to the defence, security and public aid sector, for members of the flight fund, for members of the pension fund for professional sportsmen and others clergy fund; moreover, reduced personal data requirements remain for old-age retirement in favor of rail and tram drivers, for some professional profiles enrolled in the Fpls and for some categories of seafarers.
